Abstract [en]

The current situation about the Covid-19 pandemic has led to a very heated discussion about vaccination and, above all, being or not being vaccinated in the workplace. It is a matter of conflicting interests of two different parties, the employer and the employee. At the same time as the employer has a strong right of management regarding control measures on the employees, there is an interest of the employee to safeguard their personal integrity. These two interests need to be weighed against each other and an overall conclusion is that the invasion of personal integrity must be in reasonable proportion to the interest the employer intends to satisfy.

The thesis will study the legal conditions for the employer to be able to require their employees to be vaccinated against Covid-19 in the workplace and what legally prevents employers from being able to demand that employees must be vaccinated. There is no direct legislation that regulates the issues, and it has played a major role in having to analyze different legal cases in the area. Finally, it should be mentioned that each case is different from the other and the outcome of judgments may end differently. The analysis in the essay presented is intended to provide an overall answer and can be used as guidance in future cases in the area.
