Gender norms in administrative court decisions : ​​A gender analysis of how gender is presented in LVM judgments (English)
Abstract [en]

Society is shaped by gender norms and this can be seen in several constructs, not least in courts. The aim of this study was to analyze verdicts and whether these are influenced by gender norm and if Administrative Court builds, reinforces, and/or challenges norms and perceptions of gender. A thematic analysis was conducted on 17 LVM verdicts from three Administrative Courts in Sweden. We created codes and based on these, we developed four themes. We analyzed in the context of previous research and Yvonne Hirdman's gender theory. Overall, we found that the Administrative Court uses different language depending on whether the client is female or male, with differences observed in areas such as criminality, living situation, and employment. Differences were also found in how relationships with children are addressed, with family relationships being mentioned more often in women’s verdicts. The Administrative Court treats the risk of harm to a close relative differently depending on whether the client is female or male. In the men's verdicts, this risk is mentioned without explanation, whereas in the women’s verdicts, the Administrative Court chooses not to include it.
