This chapter refers to the Boards of Appeal (BoAs) of EU agencies within the Common Foreign and Security Policy (CFSP). It analyses the CFSP as a peculiar area of EU law, notwithstanding that it is fully inside the EU legal order. It discusses how Member States (and the Council) have consistently attempted to shield matters related to the CFSP from the scope of judicial review by the Court of Justice of the European Union (CJEU). The chapter highlights the mindset of separateness of the CFSP, which applies to the way in which law-making is carried out, and to the actions of the small number of agencies within the field. It features the four BoAs in total: the European Defence Agency (EDA), the European Union Satellite Centre (SatCen), the European Union Institute for Security Studies (EUISS), and the Western European Union (WEU).
