Abstract [en]

The purpose of this study was to examine and seek understanding of mediators' approach to mediation in sex crimes. More precise, the purpose was aiming to answer what kind of experience mediators have by mediating in sex crimes, their views on opportunities and risks, and their role in the mediation process. The study has been carried out through a qualitative approach, based on six semi-structured interviews with mediators from different parts of Sweden. Theoretical concepts such as diad, triad, restorative justice and the social construction of offenders and victims of sexual crimes have been used to analyze the results. The study’s results shows that three of the mediations had worked with sexual crimes in mediation, the rest only had some, or totally lacked that kind of experience. Mediators’ degree of relevant experience was drawn to conclusion to have no particular influence on their attitudes towards acting as mediators in sex crimes. The majority of the mediators saw the suitability of mediation in sex crimes by referring to the participants’ desire to take part, not on what offenses had been committed. The risks that existed in mediation of sexual crimes were related to the power relationship between victim and perpetrator, and the guilt and shame that the victim could feel. Mediation could there for be seen as a risk of revictimization and a further violating of the victim, but the mediators also showed that mediation in sexual crimes could bring opportunities to those involved. The way the mediators worked with mediation in sexual crimes, was interpreted to contribute to the opportunities of mediation and avoid its risks.
