The representation of mothers and fathers in custody battles : A qualitative study on which influence gender has in the assessment of sole custody in Swedish courts (English)
Abstract [en]
The purpose of this study is to elucidate how mothers and fathers are presented in custody battles in Swedish courts regarding decisions on sole custody. The purpose has also been to problematize whether the parents' gender has influenced the court's assessments. Our material consists of six legal cases from the Court of Appeal and the District court. In this study we’ve used a qualitative method and applied a content analysis, when analysing our empiricism we’ve used gender theory and social construction. The previous studies in the field is contradictory, since on the one hand it shows that there are different assessment grounds related to the parents' gender in the social services child care investigations that form the basis of the court's assessment. On the other hand, there’s studies that says that there’s nothing that shows that the Swedish court takes the parents’ gender into account when they decide on custody battles concerning sole custody. The result of our study showed that the parents' gender hasn’t had any direct impact on who is to be convicted sole custody in custody battles. However, on the basis of our analysis, we found that depending on the factors of the parents that is highlighted in the arguments, it occurs that the Swedish court is gender bias based on the parents' gender.
