Patent law trajectories in blue ink.: The role of the British raj patent regime in the indigo saga

Abstract [en]
The evolution of the patent legislation in the turbulent political and economic times of the British Raj presents several interesting aspects. On the one hand a close connection to the metropole and the evolution of patent legislation in India, while on the other the particularities of the Indian administration, the legislative processes that are not always so straightforward and the market conditions under which the exclusive rights granted are to be enforced. The indigo patents paradigm provides an illustration of the myths about patenting activities and technology transfer in India, that this thesis has debunked. While the patent system in India was primarily used by Britons and other Europeans, the inventions that were patented, were not mere “technology transfers”, they were in fact technological solutions to problems that concerned India, and they very often built upon Indian traditional knowledge. In the case of indigo, as this thesis shows, the use of the patent system presented further characteristics of interest, namely the fact that patents are applied for in India while the technological war takes place in Germany and in the UK.
